MOV SHRM Meeting Thursday, September 21, 2017 6:00 p.m. to 7:30 p.m. Marietta Country Club 705 Pike Street Marietta, OH 45750 Ohio’s Medical Marijuana Laws and the West Virginia Safer Workplaces Act The West Virginia Safer Workplaces Act became effective July 7, 2017. The Act declares drug and alcohol testing that is consistent with the Act’s provisions and written policies to be legal. We will discuss the provisions of the Act, including the written policies employers need to create, the definitions used in the Act, and the legal protections afforded by the Act. Further both West Virginia and Ohio have laws touching upon employers and users of medical marijuana. We will discuss this gray area of the law on a national scale, and how it also impacts employer policies and practices relating to drug testing. PRESENTED BY Vaness Towarnicky is an Attorney with Steptoe & Johnson Law Offices in Morgantown, WV. Her primary focus is in the area of labor and employment law. She has been involved in representing clients in various employment cases, including sexual harassment; deliberate intent; age, race, and disability discrimination; wrongful discharge; and various other employment-related torts. She is admitted to various state and federal courts as well as the Third Circuit Court of Appeals and Fourth Circuit Court of Appeals. Mrs. Towarnicky provides guidance to clients with regard to compliance issues arising under state and federal employment laws, including FMLA, ADA, Title VII, the West Virginia Human Rights Act, and the Wage Payment and Collection Act. She also advises employers on compliance with the requirements of the Worker Adjustment and Retraining Notification Act.
