Medical Marijuana: Separating Fact from Fiction

FPZA REGIONAL FORUM Amendment 2 was approved by 71% of Florida residents in November 2016. On June 9th, 2017 Senate Bill 8-A was passed in a special session. This bill outlines regulations for the implementation of the hugely popular Amendment. The law explicitly preempts “all matters regarding the regulation of the cultivation and processing of medical cannabis of low-THC cannabis by dispensing organizations” to the state. However, it does allow local governments to enact ordinances specifying the locations of dispensing facilities and any other permitting requirements that do not conflict with state law or the Department of Health rule.
